The information on this website is supplied by GBYTE Technology Co., Limited, which is also known as “We,” “Us,” “Our,” and “Digitexpro.” Its registered address is FLAT 2304, 23/F HO King, Commercial Centre, 2-16 FAYUEN STREET, MONG KOK KOWLOON HONG KONG.
You acknowledge and agree to be governed by the following Terms of Use by using the Website and/or Digitexpro Services.
The terms of use that apply to you if you purchased Digitexpro Software through third-party resellers or online stores are the same as those found on this website.
The End User Licence Agreement, Privacy Policy, Refund Policy, Cookie Policy, and Referral Programme Terms & Conditions are all essential components of this Terms of Use.
The terms and conditions that apply to your access and use of the Site, the Digitexpro software (hereinafter referred to as the “Software”), and the services that Digitexpro provides (collectively referred to as the “Digitexpro Services”) made available through or in connection with the Site (hereinafter referred to as the “Service”) are described in these Terms of Use (hereinafter referred to as the “ToU”). The terms and conditions that Digitexpro uses to grant you access to the Site and the Digitexpro Services are outlined in these ToU.
THE USE OF THIS WEBSITE AND/OR THE DIGITEXPRO SERVICES CONSTITUTES YOUR BINDING ACCEPTANCE OF THESE TERMS AND CONDITIONS, INCLUDING ANY MODIFICATIONS THAT WE MAY MAKE FROM TIME TO TIME. ANY CHANGES TO THE ESSENTIAL PROVISIONS OF THE TOU WILL BE COMMUNICATED TO YOU, AND WE WILL REQUEST YOUR IMPLIED CONSENT. CONSEQUENTLY, YOU CONSENT TO THESE MODIFICATIONS IF YOU USE THE SOFTWARE AND SERVICE GOING FORWARD.
1. DEFINITIONS
1.1 Digitexpro software – a computer programme or a mobile application, the features and description of which are listed on the website. The Digitexpro programme consists of both client and server components. The Site’s web interface is used to access the server portion. The client portion is delivered as an Android.apk file that needs to be installed on the intended device. For iOS target devices, no application needs to be installed on the target device in order for the software to function. This means that features and information are gathered solely with the help of the server component, which is accessed through the Control Panel by means of the target device’s iCloud login and password.
1.2 Subscription – payments on a regular basis for software that uses and/or provides services.
1.3 Target device – smartphone, tablet, mobile phone, or other comparable device, to which software is connected through the Control Panel (if using iOS) or on which the client portion of the software is loaded (if using Android).
1.4 Payment information – Complete user name, email address, credit/debit card information, and any other data that could be required to pay for Digitexpro Services.
1.5 Payment service provider – a financial organisation that Digitexpro has a payment processing agreement with and that handles payments for Digitexpro Services.
1.6 Lawful access to a target device – user’s access to a target device that they own and the availability of additional legal justifications for gathering and using data from the target device.
1.7 Cloud control – control over a programme, application, or account that is used in conjunction with cloud technologies without requiring physical help for software installation or for the target device to function.
1.8 Digitexpro Assistance – services that Digitexpro’s experts offer and which could assist users with remote installation and troubleshooting.
1.9 Subscription month – The number of natural days in the month of payment is used to compute the paid subscription period. Only the one-and three-month subscription levels are affected by this. A 12-month subscription spans 365 or 366 days, or one calendar year.
2. GENERAL PROVISIONS.
2.1 Only in the following circumstances may the Site and the Digitexpro Services be used:
(i) – in an effort to maintain parental control;
(ii) –by people using their personal gadgets.
2.2 Security assurance of property and/or life and health of children and wards is the primary goal of software development and provision.
2.3 You must register for an account on the Site and enter personal data, including your email address, billing information, and payment method, in order to purchase and use the Digitexpro Service.
2.4 All we will get after you register for an account is your ID and email address.
2.5 You can download the.apk file from your Control Panel using the URL-link you will receive after creating an account and purchasing Digitexpro Service. In order to synchronise your account with the target device, you must click the link, download an.apk file to the device, install it, and grant the installed application the appropriate rights in order to activate the features that have been announced. When synchronising the Control Panel and the iOS target device, you must enter the target device’s iCloud login credentials in the Control Panel.
2.6 By giving your payment information to Digitexpro during the software purchase, you agree that Digitexpro does not keep this information; payment details are sent to the Payment Provider.
2.7 You understand that Digitexpro is not liable for any data breaches in databases and/or DSN servers that may occur from third parties.
2.8 You promise not to break any laws in your jurisdiction by using the Site or the Digitexpro Service. Despite the aforementioned, you are entirely responsible for any additional usage of the Digitexpro Software and we are not liable for it.
2.9 You are aware that installing the Digitexpro Software typically requires physical access to the device.
2.10 You will adhere to any guidelines and instructions that we give you on the Website.
2.11 You agree to prevent unauthorised individuals from using the Software or gaining access to your account. You agree that we are not liable if a third party gains access to your account on purpose, accidentally, or by any other means without your permission.
2.12 The software will only be installed on the devices that you own.
2.13 Your credentials (password) will be emailed to you after you register with Digitexpro.
2.14 At any time, for any reason, and without prior warning, we reserve the right to alter, discontinue, or deny anyone access to the Digitexpro Services.
2.15 We may modify these Terms of Service at any time.
3. SUBSCRIPTION
3.1 You must place the order in order to subscribe to the Service.
3.2 The Site offers a number of subscription options. The quantity of features you can select, the device you own, and the length of your subscription all affect the subscription plans.
3.3 Multiple subscriptions are permitted under a single account.
3.4 Unless you have purchased a subscription that permits you to use the Service on multiple target devices simultaneously, you must purchase a subscription for each target device.
3.5 You must provide your personal information in the Billing Information and Payment Method fields when submitting the transaction.
3.6 It is highly recommended that you either email your private encryption key to the email address listed in your subscription or download it from the Control Panel. In the event that you need to reset your password or get access back to your account and subscription(s), keep it or commit it to memory.
3.7 Since we don’t save or recall user private keys, you won’t be able to change a password, retrieve access to your account or subscription(s), or get assistance from us in regaining access to your data in the event that you misplace your private key.
3.8 The following subscription plans are available: 1, 3, or 12 months of subscription. A subscription that lasts for a full year has 365 or 366 calendar days.
3.9 You understand that if you purchase a subscription plan, you can use a client portion of the Software for multiple target devices, but you will need to reinstall it from the current device to the new one, unless you have purchased a subscription that permits you to use the Service on multiple target devices simultaneously.
3.10 In order to prevent any inconvenience, the subscription you have chosen will be automatically renewed for an additional period of the same length at the full, non-discounted price.
3.11 You can buy more services when you pay for a membership. Payment terms and amounts are determined by the services selected.
3.12 You acknowledge and accept that we will not be held responsible for the results of our services. We disclaim all liability if the services provided cause damage to the target device.
3.13 Unless auto-renewal is disabled at least 24 hours prior to the conclusion of the current subscription plan, the subscription will automatically renew. Even in cases when the Software was momentarily inaccessible for technical reasons, we reserve the right to bill you for the future payment subscription if you failed to disable automatic renewal. When the payment is being executed on the website, there will be a unique option to cancel the automatic renewal. Due to a discount cancellation, the renewal price for a new subscription period may differ from the original subscription price. We will email you a confirmation letter with the original and renewal prices as soon as your payment has been successfully processed.
You must stop automatic renewal in the Control Panel if you disagree with the renewal pricing.
3.14 You will be billed at the beginning of the following term for the subscription if you failed to turn off automatic renewal. You can terminate a subscription using the Control Panel or by sending an email to our support staff for assistance. You acknowledge and agree that there won’t be a refund if you neglect to turn off auto-renewal for the upcoming subscription month. Should you fail to disable your order’s auto-renewal, you will be billed for the subsequent subscription month. You must get in touch with the support staff to unsubscribe.
3.15 You are never allowed to use another person’s account without their consent. You must enter correct and comprehensive information while creating your account.
3.16 You alone are in charge of everything that happens through your account, and you also need to make sure that your password is safe.
3.17 No account may be transferred or shared. Your password may not be shared with anybody else.
3.18 Any unauthorised use of your account, security breach, or suspicion that your password may have been compromised must be reported to us right away.
3.19 If your account is used without authorization, we won’t be responsible for any losses you sustain.
3.20 You can adjust the accessible parameters to engage with the Digitexpro Services via your Account/Control Panel.
3.21 Anything that happens under your account is your responsibility.
3.22 By creating or accessing an account on someone else’s behalf or using a false identity or information, you agree not to do any of the following.
3.23 If you have previously had your account deleted by us or been banned from using the Digitexpro Services, you consent to not creating an account or using the Digitexpro Services.
3.24 Anytime you want, you can deactivate any account you own. Any account that is linked to your name may be cancelled simply following the directions on the website.
3.25 You have the option to reactivate an account using the Site’s Control Panel at any moment if you choose to voluntarily close it or let it expire. We have the right to cancel accounts that we terminate for any reason, including but not limited to violating these Terms of Service. The monitoring of all devices on which the Software is installed will end upon any suspension or termination of the Digitexpro Services. You might no longer be able to access any information you have submitted on the Site or that is associated with your account.
3.26 You can use your private encryption key to regain access to the account in the event that you forget your password.
3.27 We might suggest and resell the goods (software, mobile applications, etc.) of third parties. It can be purchased in addition to or apart from your primary subscriptions. You can discover links to terms and conditions, privacy policies, licence agreements, and other information relating to using these third-party products on the relevant sections of the website. These third-parties will offer these terms and conditions. You understand that, even though we may suggest utilising such third-party tools, Digitexpro is not liable for them and that using them is entirely your responsibility. If you have any inquiries concerning the use of products from third parties, installation issues, error correction, etc., you should submit your request to the relevant supplier.
Digitexpro cannot help with installation or usage issues for these items; however, the relevant vendor can supply you with the information you need. We will send you our urgent contact information upon request. To discuss bills and other financial issues, please contact us using Live Chat or the email support@digitexpro.net. After you make a payment, you will receive instructions on how to download and install third-party products. These guidelines will be communicated by email and/or posted on the website.
4. SUPPORT SERVICES
4.1 We make an effort to support every user. You can contact us via email or live chat for any questions pertaining to Digitexpro Services. You can contact us via email or live chat at any time for free.
4.2 When you purchase any form of subscription, you have the option to order Digitexpro Assistance service on the checkout page. You must pay for Digitexpro Assistance under the one-time prepayment terms if you wish to use this service. Digitexpro offers its assistance service, Digitexpro Assistance, to a single target device only, over the phone and/or through specialised remote access software. If you need Digitexpro Assistance again because you misplaced the target device, the Digitexpro application or target device was damaged during installation, or for any other reason, you should pay for Digitexpro Assistance once more (one Digitexpro Assistance service for one installing). Keep in mind that depending on the specifics of the device model, the installation may or may not succeed. In order for the remote installation or reinstallation session to be successful, we need: Target device must have its screen unlocked in order to: (i) have physical access for at least ten minutes; (ii) have a steady Internet connection. The following information may be needed during the installation process: PIN code, screen unlock password, associated Google/iCloud account credentials, and Wi-Fi password.
4.3 All Languages are Available for Our Live Chat Support Services. Only English, German, French, Spanish, Portuguese, Italian, and Japanese are available for our email support services. It is not grounds for a refund if you do not know any of these languages.
5. BILLING PROCEDURE
5.1 Every account is created with a prepaid balance. Before any billable product or service is delivered and/or enabled, we must collect payment. To be charged for any one-time or multiple-payment consulting costs as well as any recurring monthly membership payments, you must maintain active credit or debit cards on file.
5.2 Your subscription is determined by the availability of Digitexpro Services, not by how often you use (or don’t use) the software. You will need to buy further subscriptions if you wish to install the Software on more devices.
5.3 While utilising the Digitexpro Services, you are in charge of maintaining the accuracy of all credit/debit card information and contact details.
5.4 You must periodically verify that the data in your account profile inside Digitexpro Services is accurate.
5.5 By default, Auto Upgrade is turned on. You will receive a payment notification from us following the execution of your subscription payment. You can request access to all of your receipts. Although the cost of Digitexpro services is covered by the subscription fee, there may occasionally be additional expenses. For technical support with installing the software, there are extra fees.
5.6 Methods of payment. Any payment made with any major debit or credit card will be accepted. Any other form of payment, including checks or wire transfers, requires our express written authorization, which we will grant at our sole discretion. You must select the required payment option and provide your payment information, which includes the card number, CVV code, and expiration date, in order to make a payment.
6. BILLING CYCLE
6.1 Process for Recurring Billing.At the start of each billing cycle, we shall charge you (the “payment date”). To make things easier for you, we will automatically charge your credit or debit card for the monthly payment terms specified in the relevant subscription plan (either after one, three, or twelve months of subscription, depending on the plan you choose).
6.2 If your card on file is denied for any reason, we will attempt to re-run the charge for the cards on file up to two (2) more times in a 24-hour period. If we are unable to charge the funds from your card within the specified time frame, your account will be cancelled.
6.3 Not enough money. We reserve the right to give you a discount on any kind of purchase and charge the subscription payment at a reduced amount if there are not enough money in your accounts or cards. This could be related to the original purchase, a subscription renewal, or an upgrade—including those carried out via the Control Panel.
6.3.1 We may give you a 25% discount and only charge you 75% of the membership amount if we attempt to charge your card and there are not enough funds available. We will subtract an extra $4.99 from the total if there are still insufficient funds on your card after the applied 25% discount. Your account will be closed if we are unable to debit the discounted rates mentioned above from your card.
6.3.2 Digitexpro software will be provided to you for the subscription period proportionate to the applied discount (75% or or 75% minus an additional $4.99 of the time from the chosen subscription period, respectively) if we are able to charge funds from your card with a discounted price (75% or 75% minus an additional $4.99).
6.3.3 If you purchased the Digitexpro software at a reduced cost as a result of a discount you received from us during one of our marketing campaigns, and there weren’t enough funds available on your account or card at the time of the purchase, we reserve the right to give you a further discount and charge your subscription in line with clauses 6.3.1 and 6.3.2 of this ToU.
7. SOFTWARE APPLICATION
7.1 You may only use the Software in accordance with the Service End User Licence Agreement and any guidelines, limitations, or documentation that we may from time to time provide.
7.2 You agree that we may, at any time and for any reason, suspend or cancel any licence granted under it and deactivate the Software’s operation. This is our sole discretion. In this scenario, the data you may have previously viewed will suddenly become inaccessible.
7.3 At our sole discretion, we reserve the right to add or remove any features or functions from the Software at any time.
7.4 You can contact customer care at support@digitexpro.net to re-link your device if it was disconnected from the software as a result of an operating system update. It is important to keep in mind that re-linking your target device operation system has no guarantee and is done at your own risk.

8. ACCEPTANCE
8.1 By accessing this website and/or the Digitexpro Services, you attest to having read and agreed to the End User Licence Agreement, Privacy Policy, Refund Policy, Cookie Policy, and Terms & Conditions of the Referral Programme.
8.2 We reserve the right, at any time and without prior notice, to modify these Terms of Use, End User Licence Agreement, Privacy Policy, Refund Policy, Cookie Policy, and Referral Programme Terms & Conditions. The updated versions will be posted on the Site.
8.3 You shall stop using the Site and/or Digitexpro Services right away if you disagree with any part of these Terms of Use, End User Licence Agreement, Privacy Policy, Refund Policy, Cookie Policy, and Referral Programme Terms & Conditions.
9. SECURITY
9.1 The security and integrity of your personal data are important to us.
9.2 You agree that, by placing the Product order, you voluntarily give Digitexpro and the Payment Provider access to your personal information.
9.3 You acknowledge that we might use your personal data to get in touch with you about the Digitexpro Service and to send you marketing or promotional materials, newsletters, and other information. Unsubscribing is always an option for the user.
9.4 For further information about our guidelines for handling personal data and securely keeping it, kindly read our Privacy Policy.
9.5 You acknowledge that we have given you the private encryption key and that you must keep it.
9.6 In the event that (i) the data is older than three (three) months or (ii) your account has expired, we are not able to gather and/or store in its database any exported logs and data from a target device with the use of the software.
9.7 All logs and data exported from a target device using the software will be erased one month after your account expires. Even if you don’t use your account, we have the right to keep it in order to protect our legitimate interests and your convenience.
9.8 We have no control over, don’t keep an eye on, or are unaware of the ways in which users abuse the software. If it is used inappropriately, we might not be held accountable. The user bears all liability and risk for it.
9.9 You understand that we do not advocate for our users to engage in illicit usage of the Digitexpro Services.
10. REQUIREMENTS TO A USER
10.1 You acknowledge and agree that you are at least eighteen years old when you place an order for the Software.
10.2 You understand and agree that: (i) you are the owner of this device; and (ii) you are the parent of your minor child or the guardian of a ward when you install the software on a device.
11. SOFTWARE UPDATES
11.1 We may occasionally upgrade the software programme in an effort to enhance the Digitexpro Services and error correction.
11.2 You accept and understand that we are free to update the Software with or without your consent.
11.3 You understand and consent that we might ask you to update the software on a target device by email or through the Control Panel.
11.4 You acknowledge and accept that we bear no responsibility for any injury or damage a software upgrade may cause to a target device.
12. REFUNDS AND RETURNS.
12.1 If for any reason you are unhappy with the software, we guarantee returns. However, this does not imply that refunds will always be granted. Depending on the Product package, subscription plan, amount of time since the transaction, etc., you might not be eligible for a refund. Before you begin using Digitexpro Services, we advise you to study our Refund Policy for more information.
13. INTELLECTUAL PROPERTY
13.1 Commercial Marks. Digitexpro uses its logo as a trademark or service mark.
13.2 It is illegal to use Digitexpro’s trademark, service mark, or logo without permission. This is against both national and international trademark regulations.
13.3 Rights of reproduction. International copyright laws and the applicable law protect the Site, Service, and Software.
13.4 Digitexpro or its licensors own all intellectual property in the layout, design, and content of this website, as well as any material or information published on its pages. Except for the following, you are not allowed to reproduce any content from this website or take any other action in connection with it:
13.5 For your personal, noncommercial use only, you may print or save pages from this website to a local hard drive;
13.6 You may only quote content from this website in materials that you offer to third parties, as long as the quotes are not utilised misleadingly and you provide proper attribution to Digitexpro and the author.

14. DISCLAIMER OF WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW

Before relying on any information, it is your responsibility to confirm it.

We do not guarantee that you will be able to access or use the website and/or service at the times and locations of your choosing, that there will be no interruptions or errors, that errors will be fixed, that defects will be fixed, or that there are no viruses or other harmful components on the website or service.

15. LIMITATION OF LIABILITY. SOLE AND EXCLUSIVE REMEDY
15.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITEXPRO, ITS AFFILIATES, LICENSORS, AND BUSINESS PARTNERS (COLLECTIVELY, THE “RELATED PARTIES”) DISCLAIMS ALL LIABILITY, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND FURTHER DISCLAIMS ALL LOSSES, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH ACCESS TO OR USE OF THE SITE, THE SOFTWARE, AND/OR SERVICE, EVEN IF WE AND/OR RELATED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
15.2 Notwithstanding the foregoing, in no event shall DIGITEXPRO’s or any related party’s liability exceed the fifty dollars or the amount you paid to us or our designees during the six (6) months prior to the date the cause of action giving rise to liability arose.
15.3 Due to the fact that certain states or countries prohibit the exclusion or limitation of responsibility for consequential or incidental damages, Digitexpro and its affiliates’ liability will be restricted to the maximum extent allowed by law in those states or jurisdictions.
15.4 Users who use the software and/or the site in an illegal manner or with illegal intentions are not under the control of Digitexpro. It is prohibited to use the software and/or services in a way that violates the rights, freedoms, or interests of third parties. They are only developed and provided for security purposes. IT IS NOT KNOWN OR POSSIBLE FOR DIGITEXPRO TO KNOW HOW USERS USE THE SOFTWARE AND/OR SERVICES. YOU CAN NOTIFY US AND WE WILL ADOPT THE BEST EFFORTS TO STOP THE UNLAWFUL USING OF THE SOFTWARE AND/OR SERVICES IF YOU LEARN THAT THEY ARE USED OR WERE USED UNLAWFULLY.
15.5 DIGITEXPRO IS NOT LIABLE FOR USING PRODUCTS BOUGHT FROM THIRD PARTIES ON THIS WEBSITE (APART FROM PAYMENT ISSUE). You should direct any inquiries and claims regarding the use, installation, error correction, removal, reinstallation, access, and other related matters to the manufacturers of said products.
16. INDEMNIFICATION
16.1 By using the Site, the Software, and/or the Service, or by violating these Terms of Service or any other policies that we may periodically issue for the Site, the Software, and/or the Service, you agree to indemnify, defend, and hold Digitexpro and the related parties harmless from any and all claims, demands, damages, or other losses, including reasonable attorneys’ fees.
17. ASSIGNMENT
17.1 With or without your approval, we may at any time assign these ToU, in whole or in part, to any person or entity.
17.2 You may not assign the ToU in any way without our prior written approval; any attempt on your part to do so will be deemed void.
18. MISCELLANEOUS
18.1 Should any part of these Terms of Service be found to be invalid or unenforceable, that piece will be removed, leaving the remaining portions of the ToU fully enforceable.
18.2 Digitexpro’s inability or inability to enforce adherence to the Terms of Service does not amount to a waiver of these terms.
18.3 Digitexpro’s express waiver of any ToU requirement, condition, or provision does not relieve it of any further need to abide by the same or similar requirements in the future.
18.4 Any written notices that you give or that are required by this TOU should be sent to:

2) support@digitexpro.net—for any inquiries pertaining to law.
3) For questions about privacy and personal data, contact support@digitexpro.net (Data Protection Officer).
18.5 This Terms of Use incorporates by reference all Policies and other documents that are posted on the Site.
18.6 If the subscription expires, the service may be discontinued.
18.7 We maintain the right, at our sole and complete discretion, to refuse service to any user.
18.8 By using the Digitexpro Services, you agree that we may, at any time, and for any reason (including, but not limited to, violating these Terms of Use), cancel your subscription and/or your access to the Digitexpro Services.
18.9 We have the right to discontinue providing the Digitexpro Services at any time.
18.10 We reserve the right to refuse service to any user, including without limitation a user who tries to monitor the device of a person without that person’s agreement, or to terminate the service of any user. We reserve the right in this situation to block all accounts connected to the potentially offending user.
18.11 A few legal rights are outlined in these ToU. The laws of your state or nation may grant you further privileges. Your legal rights under the laws of your state or nation remain unaffected by these ToU.
18.12 The laws of the UK shall govern and be applied to the interpretation of these Terms of Service and any other agreements we may supply you.
18.13 You understand and agree that it is your responsibility if the laws of your state or nation forbid you from using the Software application entirely or only in part.
